Agency Booking Agreement

THIS CONTRACT for the services of the music and/or entertainment described below is made today, ................................................ 2003. Between the undersigned Purchaser of music and/or entertainment (hereinafter called the Client) and the undersigned Artist(s) (plus any accompanying musicians and/or entertainers hereinafter called the ACT). The Client hereby engages the Act and the Act hereby agrees to perform the engagement hereinafter provided with all the terms and conditions herein set forth including those entitled 'Additional Terms and Conditions'.

PAYMENT PROCEDURE

TERMS AND CONDITIONS

 

LIABILITY
The persons signing for the Client (Purchaser of the Entertainment) and the ACT (Musicians, DJs, entertainers, etc.) agree to be personally, jointly and severally liable for the terms of this contract.

The persons signing this contract hereby confirm their full capacity and authority to do so.

CANCELLATION
In the event of a cancellation, a fee will be due as follows:
The deposit (booking fee) - non-refundable
More than 150 days prior to booking date - 20% of contracted amount
Between 100 and 150 days prior to booking date - 40% of contracted amount
Between 30 and 100 days prior to booking date - 75% of contracted amount
Less than 30 days - 100% of contracted amount

DEFAULT BY CLIENT
Liquidated damages of the ACT will be the amount stated in Balance in Section 8 plus reasonable solicitors' fees and court costs. The deposit will be retained by the Agent (Reggaeton Bookings) for services already performed.

RESIDENTIAL CONTRACTS
The Management will provide: 
a) security services for the ACT 
b) air and ground travel expenses 
c) accommodation for the ACT Full Board + Meals 

REBOOKINGS
If the leader or any key personnel of this ACT is rebooked into this or any establishment represented by the Client (including chains linked to the premises) within 12 months from the termination of this Agreement, both Client and ACT shall be jointly and severally liable for payment to Reggaeton Bookings for commission in the rate set forth in this contract.

BEHAVIOUR GUIDELINES
Members of the ACT and personnel should refrain from eating and drinking on the premises of all private functions unless invited to do so by the Client. No guest of the ACT is permitted without the consent to the Client. At all times during the engagement members of the ACT will dress appropriately (see dress code), be polite, sober and cheerful.

THE ACT and its members will follow the rules and regulations of the establishment provided those rules and regulations do not prevent or affect the quality of the performance..

FORCE MAJEURE If the ACT is unable to perform owing to proven detention, sickness, accidents, riots, strikes, epidemics, acts of GOD, or any other legitimate conditions beyond their control, the Agent (Reggaeton Bookings) will take all reasonable measures to provide a suitable alternative ACT.

THIS CONTRACT constitutes the sole, complete and binding agreement between the ACT and the Client. The Agent (and its employees) act only as Agent, consultant or manager and assumes no responsibility or liability as between the Client and the ACT.
